Mississippi imposes no state-level restriction on residential rainwater harvesting. DeSoto County and its cities allow rain barrels and cisterns without a permit for typical residential garden and irrigation use.
Mississippi recognizes rainwater as belonging to the landowner and does not regulate residential collection. DeSoto County's Planning and Zoning Ordinance does not restrict rain barrels, and the cities of Southaven, Olive Branch, Horn Lake, and Hernando follow the state default. Typical 50 to 100 gallon rain barrels at downspouts need no permit. Cisterns above roughly 5,000 gallons or any connection to the household plumbing triggers a building and plumbing permit under the Mississippi-adopted International Plumbing Code. Potable use is not permitted without treatment meeting Mississippi State Department of Health standards. DeSoto Regional Utility Authority customers may use harvested water for outdoor irrigation without reporting. HOA covenants (common in Southaven master-planned communities) may restrict visible barrels.
No penalty for standard residential collection. Unpermitted cistern over threshold or plumbing cross-connection: building code violation $100 to $500 plus disconnection order. Cross-connection to potable system: MSDH enforcement.
