NYC Administrative Code section 24-219 and Department of Environmental Protection Noise Mitigation Rules at 15 RCNY chapter 28 require every construction site to keep an approved noise mitigation plan on site and limit weekday work to 7 a.m. through 6 p.m. unless an after-hours variance issues.
Local Law 113 of 2005 rewrote the NYC Noise Code, adding Admin Code sections 24-218 through 24-220 and chapter 28 of Title 15 of the Rules of the City of New York. Section 24-219 requires every construction site to maintain a written Noise Mitigation Plan addressing equipment selection, work scheduling, sound barriers, and complaint response. DEP and DOB enforce the rule citywide. Construction is generally allowed Monday through Friday 7 a.m. to 6 p.m. After-hours work needs an Authorized Variance from DOB under section 24-223 or qualifies under emergency exceptions. Specific equipment caps include 85 dBA at 50 feet for paving breakers and 90 dBA at 50 feet for backhoes per 15 RCNY 28-103.
First-time noise mitigation plan violations carry $440 fines, rising to $880 second and $1,760 third under Admin Code section 24-257. Operating without a plan or filing a false one can trigger $3,500 daily fines and DOB stop-work orders.
