Loudoun County enforces strict noise standards for HVAC and mechanical cooling equipment under Zoning Ordinance Section 5-1507 and Codified Ordinances Chapter 654.02. With Ashburn being the epicenter of 'Data Center Alley' (hosting 70%+ of the world's internet traffic), data center cooling systems are a major noise source. Maximum sound levels at residential property lines are 55 dBA. As of March 2025, data centers now require Special Exception approval with enhanced noise mitigation including pre- and post-construction noise studies, soundproofed mechanical equipment, and bermed buffers.
Loudoun County's noise regulation for HVAC equipment operates on two levels. The Zoning Ordinance Section 5-1507 sets maximum A-weighted sound levels measured at receiving property lines: 55 dBA for residential and rural economy uses, 60 dBA for mixed-use residential, 65 dBA for commercial/civic/institutional, and 70 dBA for industrial. These limits apply at all times, day and night. Notably, air conditioner condensers for single-family dwellings are exempt under Section 5-1507(F)(5), but commercial and industrial HVAC systems including data center cooling equipment are NOT exempt. Data center cooling is a defining issue in Ashburn and eastern Loudoun. The county hosts over 300 data centers concentrated along the Dulles Greenway corridor. Their massive cooling systems (chillers, cooling towers, CRAC units, and fans) can generate sustained noise. In March 2025, the Board of Supervisors approved Phase 1 of the Data Center Standards and Locations initiative, eliminating by-right data center development in IP, GI, and MR-HI zoning districts. All new data centers now require Special Exception (SPEX) approval, which includes conditions for soundproofing rooftop and ground-mounted mechanical equipment, pre- and post-construction noise studies, limited generator testing hours, fully screened mechanical equipment areas, and enhanced buffers on top of a six-foot-tall berm adjacent to residential properties. Phase 2 (approved September 2025) further addresses use-specific performance standards for noise mitigation. The general noise ordinance Chapter 654.02 also prohibits any sound that is audible and discernible inside another person's residential dwelling with doors and windows closed.
Violations of Section 5-1507 noise limits are enforced by Loudoun County Zoning Enforcement. Violations of Chapter 654.02 are enforced by the Loudoun County Sheriff's Office and carry Class 3 misdemeanor penalties (up to $500 fine) for first offense, escalating to Class 2 (6-month repeat) and Class 1 misdemeanor (up to 12 months jail and $2,500 fine) for repeat offenses within one year. Data centers operating under SPEX conditions face potential revocation of their special exception approval for persistent noise violations.
