Under the Polk County Outdoor Concert Ordinance, outdoor concerts in unincorporated areas may not be conducted after 11:00 p.m. or before 10:00 a.m. Everyday amplified outdoor music is also limited by the noise-disturbance rule.
Sec. 10.5-41(f) provides that "Outdoor concerts shall not be conducted after the hours of 11:00 p.m. and before 10:00 a.m." An outdoor concert means an amplified performance of singers, instrumentalists or recorded/electronic music on a stage, tent or open-air structure. The board may grant a per-event variance. Separately, routine outdoor amplified music is governed by Sec. 10.5-55(1) and the general noise-disturbance standard (plainly audible 50 feet). Applies to unincorporated Polk County.
Outdoor-concert violations are prosecuted like a misdemeanor with a fine not exceeding $500 or up to 60 days in jail, or both (Sec. 10.5-41(g)). Each separate occurrence is a separate violation.
