Quiet hours in Pascagoula, MS โ also called the noise ordinance, nighttime noise rules, or residential quiet time โ define the hours during which excessive noise is prohibited.
Pascagoula has no stand-alone numeric decibel quiet-hours code. Time-based noise limits live in the Unified Development Ordinance (UDO) Section 6.12 residential compatibility standards: amplified music, singing, or other noise audible at lot lines abutting single-family homes must be extinguished by 9:00 PM Sunday-Thursday and 11:00 PM Friday-Saturday. Mississippi grants nuisance authority via Miss. Code Ann. ยง21-19-1 and ยง17-1-3.
Pascagoula's UDO Section 6.12 (Operational Standards for residential-compatibility uses) requires neighboring commercial and mixed-use operations to: cease outdoor dining or activities by 9:00 PM Sunday-Thursday and 11:00 PM Friday-Saturday; limit trash collection or service functions to 7:00 AM-7:00 PM; and extinguish amplified music, singing, or other noise audible at single-family lot lines after the same 9 PM/11 PM thresholds. UDO Section 4.3.D.5.b also caps outdoor restaurant seating operations at 11:00 PM and requires a 100-ft setback from Single-Family Residential (SFR) districts. Small wind energy systems (UDO Section 4.4.F) cannot exceed 55 dBA at a residential property line. General disturbance complaints fall under the Pascagoula Police Department, which enforces Mississippi disturbing-the-peace statutes and city nuisance powers granted by Miss. Code Ann. ยง21-19-1 (general health/sanitation) and ยง17-1-3 (zoning/welfare). The Ingalls Shipbuilding complex and Chevron Refinery operate under industrial zoning where these residential compatibility rules do not apply.
UDO violations are enforced by Code Enforcement and may trigger written notice, abatement orders, and citations under Pascagoula's general penalty (Code ยง1-12). Continued noncompliance can be prosecuted as a public nuisance and result in municipal court fines, abatement costs, and potential certificate-of-occupancy issues for commercial uses near single-family districts.
