Houston's 2023 Residential Buffering Ordinance addresses light trespass from new commercial developments adjacent to residential areas. Wall and pole-mounted fixtures must be fully enclosed and shielded. General nuisance provisions under Chapter 10 may also apply.
The Residential Buffering Ordinance (January 25, 2023, effective February 25, 2023) amended Houston's Construction and Electrical Codes to require all outdoor wall or pole-mounted light fixtures on new commercial properties to be fully enclosed in the fixture housing and properly shielded to prevent light trespass onto residential properties or streets. Garage screening and lighting standards prevent headlights from parking garages from shining on adjacent residential properties. These rules apply to building permit applications for commercial properties filed on or after February 25, 2023. For light trespass not covered by the buffering ordinance (neighbor-to-neighbor residential disputes), residents may pursue nuisance claims under Chapter 10, Art. XI or through civil court. Houston does not have a comprehensive residential light trespass ordinance.
Non-compliant commercial lighting may fail building inspection. Nuisance complaints may result in enforcement under Ch. 10 with fines of $200-$2,000.
