Moreno Valley requires a building permit for any deck more than 30 inches above grade and for most patio covers, per the California Residential Code adopted in MVMC Title 8. Ground-level patios on grade are permit-exempt but must still meet setbacks under MVMC 9.08.
Under MVMC Title 8 (which adopts the California Residential Code) and California Building Code Section R105.2, a building permit is required for any deck whose walking surface is more than 30 inches above the lowest adjacent grade at any point within 36 inches horizontally. Decks 30 inches or less above grade and not serving a required exit are typically permit-exempt structurally but still must meet zoning setbacks. Patio covers - solid roof or open lattice attached to a dwelling - require a building permit and an engineered design per California Residential Code Appendix H, including snow- and wind-load calculations (Moreno Valley uses CRC default wind loads; engineered drawings are required for spans common in patio covers). Concrete patio slabs at grade with no cover are permit-exempt. All decks and patio covers must comply with MVMC Chapter 9.08 setback rules, lot-coverage limits, and HOA architectural review where applicable. Apply through the Accela SimpliCITY portal or at City Hall (14177 Frederick St., 951-413-3350).
Building a deck more than 30 inches above grade or a patio cover without a permit is a violation of MVMC Title 8. Penalties include stop-work order, mandatory removal or retroactive permitting at investigation rates, and general municipal penalty (up to $100/$200/$500 escalating per Cal. Gov. Code Β§36900). Unpermitted work can also block resale/refinance and trigger insurance denial in the event of failure.
