Under Philadelphia Code 9-810 (Good Cause Eviction), a landlord ending a tenancy for landlord cause such as substantial renovation, owner move-in, sale of unit, or removal of the unit from the rental market must pay relocation assistance equal to two or three months of the unit's monthly rent. The payment is due before the tenant vacates and must be documented in the notice. Failure to pay or improper notice is a complete defense to any subsequent ejectment action filed in Philadelphia Municipal Court. Pennsylvania has no statewide relocation rule, so this protection is local. The Fair Housing Commission enforces non-payment claims and can issue cease-and-desist orders.
Skipping the required relocation payment voids the eviction notice and bars the landlord from filing for possession until the funds are tendered with statutory penalties available.
