Idaho Code 67-6529 (within the Local Land Use Planning Act) and Idaho Code 22-4501 et seq. work together to protect agricultural zoning and operations. The Right to Farm Act, especially 22-4503, prohibits local ordinances that would force changes to or restrict established agricultural operations on land zoned for agriculture. Counties retain authority to adopt comprehensive plans and zoning, but must consider agricultural impacts and provide procedures protecting farm operations during rezoning. Conflicts between residential and agricultural uses generally resolve in favor of pre-existing farm activity under the come-to-the-nuisance doctrine codified in Title 22. Cities annexing agricultural land must respect existing operations during the transition. Local agricultural-zoning rollbacks are limited.
Restrictive local zoning conflicting with Title 22 protections is void. Affected farmers may seek injunctive relief and recover attorney fees in successful actions.
