Under K.S.A. 2-3201 through 2-3204, Kansas grants strong protection to qualifying agricultural activities including livestock production, crop farming, and related operations that have been in existence for one year or more. Such operations cannot be deemed a nuisance due to changed conditions in or about the locality, such as residential development encroaching on long-standing farms. Protection does not apply if the operation is conducted negligently, in violation of state or federal environmental law, or if it has substantially changed in nature after surrounding non-farm uses became established.
Nuisance suits against protected farms may be dismissed and the prevailing farm operator may recover costs and reasonable attorney fees.
