Rensselaer County does not cap annual rental nights. No town in the county currently enforces a night cap on non-owner-occupied STRs. Troy requires registration but does not limit rental nights.
Unlike New York City (30-day minimum stay rule for unhosted rentals) or many resort communities, Rensselaer County and all of its municipalities allow unlimited annual rental nights. Troy's STR Ordinance requires registration and renewal but does not impose a night cap; hosts may operate 365 days a year so long as they remain compliant with insurance, occupancy, and nuisance standards. Non-owner-occupied (investor) STRs are generally allowed; Troy does not distinguish between owner-occupied and non-owner-occupied for night limits. The December 2024 NY statewide STR law effective March 2025 requires platforms to collect/remit 4 percent state sales tax plus local taxes and report to DOS quarterly but did not impose night caps. Rensselaer County has not adopted a county-wide registry under the optional provision of the 2024 law.
No fines for exceeding night limits because none exist. Operating without Troy STR registration: $500-$1,500 per day until registered. Failure to remit NY sales tax collected: interest and penalty under Tax Law 1145.
