Cities like Seattle, Berkeley, and Washington, D.C. have banned single-use plastic straws or required customers to ask for one before service. Boise lacks authority for such a rule because Idaho Code 39-7405's preemption covers straws as auxiliary containers. The 2016 statute was specifically designed to prevent the cascade of straw and foam bans then spreading through coastal cities. As a result, Boise restaurants distribute plastic straws by default, with no opt-in or opt-out mandate. Some chains voluntarily use paper or compostable straws as a brand choice; this is permitted but cannot be required by the city.
