The Maine Revised Statutes impose no statewide restriction on single-use plastic straws. LD 602, An Act To Prevent Pollution from Single-use Plastic Straws, which would have required food establishments to provide plastic straws only on customer request, received an Ought Not To Pass report and died in the 130th Legislature in June 2021; no straw provision was enacted. (38 MRS § 1614, sometimes cited for a straw rule, actually governs products containing PFAS.) Straw regulation is therefore entirely municipal under 30-A MRS § 3001 home-rule authority; Portland's single-use plastics ordinance requires straws, stirrers, and splash sticks only on request, with an exception for customers who need them for accessibility.
No statewide penalty exists because there is no state straw statute. Where a municipality such as Portland has adopted a by-request ordinance, enforcement and fines are set by that local code.
