Building on the plastic straw rule, Delaware's single-use foodware provisions in Title 7 require food service establishments and third-party delivery services to refrain from including disposable utensils, stirrers, and condiment packets in takeout and delivery orders unless the customer requests them or affirmatively opts in through the ordering interface. Wilmington restaurants are responsible for setting POS defaults, training staff, and configuring delivery app menus to be opt-in. The rule applies regardless of utensil material when offered as bundled freebies.
Noncompliant restaurants face DNREC warnings, education, and civil penalties; recurring violations can be cited daily.
