Alabama State Building Code Setback Authority Framework

Under Alabama Code Section 11-52-70 et seq., municipalities have authority to enact zoning regulations including setbacks, but the state-adopted Alabama Residential Code (IRC) imposes baseline fire-separation requirements between structures and from property lines that apply statewide. The Alabama Department of Public Health under Chapter 420-3-1 sets minimum setbacks for onsite sewage disposal systems (typically 5-10 feet from property lines, 50-100 feet from wells). These septic setbacks preempt local rules that would allow lesser distances. Counties without zoning generally lack setback authority outside subdivision regulations.

Septic setback violations can void permits, require system removal, and result in ADPH enforcement. Fire-separation code violations block certificate of occupancy.
