Arkansas E-Verify Requirements for State Contractors

Arkansas Code 19-11-105 mandates that state agencies and political subdivisions verify the work eligibility of all newly hired employees using the federal E-Verify system or an equivalent. Contractors and subcontractors performing public contracts must certify that they do not knowingly employ unauthorized workers and that they participate in E-Verify. Failure to comply can result in contract cancellation, debarment from future bidding, and reporting to federal authorities. The requirement applies statewide and preempts inconsistent local procurement rules. Private employers are not generally mandated to use E-Verify under this statute, but public-contract participation is conditioned on compliance.
