Delaware Firearms in Vehicles Rules

Under Title 11, Section 1442 of the Delaware Code, carrying a concealed deadly weapon includes a handgun kept within reach inside a motor vehicle. Drivers without a Concealed Deadly Weapon License must transport handguns unloaded and ideally locked in the trunk, glove box, or a separate container, with ammunition stored apart from the firearm. Long guns are typically permitted if unloaded and not concealed on the person. The State Police interpret a handgun in a center console or under a seat as concealed, even if the driver claims it is for self-defense. Operating a vehicle with a loaded handgun while impaired adds further charges under 11 Del.C. 1448.

Unlicensed concealed carry of a handgun in a vehicle is a Class G felony under 11 Del.C. 1442, punishable by up to two years in prison plus firearm forfeiture.
