Delaware E-Verify Requirements for Employers

Delaware has not adopted a state law mandating E-Verify for private employers. Businesses operating in Delaware must still comply with the federal Immigration Reform and Control Act through Form I-9 verification for each new hire. Limited E-Verify obligations may apply to specific federal contractors under the federal FAR E-Verify clause, but those flow from federal procurement rules rather than Delaware statute. State and local government hiring practices follow agency-specific personnel rules. Legislation proposing broader E-Verify mandates has been introduced in the General Assembly but has not been enacted through 2026.

Because Delaware imposes no state E-Verify mandate, there are no state penalties for non-use; federal Form I-9 violations remain enforceable by ICE under federal law.
