Delaware Flavored Tobacco Product Restrictions

Unlike Massachusetts or New Jersey, Delaware has not passed comprehensive legislation banning the sale of flavored tobacco or menthol products. Federal Food and Drug Administration policy restricts flavored cartridge-based e-cigarettes other than tobacco and menthol. Delaware's Clean Indoor Air Act and Tobacco 21 framework remain the primary state-level controls. Legislation to ban flavored tobacco has been introduced in recent General Assembly sessions but has not been enacted.

Selling federally restricted flavored cartridge e-cigarettes can trigger FDA enforcement and Delaware retailer license discipline up to 1000 dollars per offense.
