Georgia E-Verify Mandate Under O.C.G.A. 36-60-6

O.C.G.A. 36-60-6 mandates that every private employer with more than 10 employees register for and use the federal E-Verify work authorization program to confirm the employment eligibility of newly hired employees. As a condition of obtaining or renewing a county or municipal business license, occupational tax certificate, or similar authorization, employers must submit a sworn affidavit listing their E-Verify user identification number and the date of authorization. Public employers and contractors face additional verification rules under O.C.G.A. 13-10-91. The statute applies statewide and preempts inconsistent local enforcement schemes.

Non-compliant employers may be denied business license issuance or renewal; false affidavits may incur perjury penalties.
