Georgia Industrial Noise Under State Environmental Law

Unlike many states, Georgia has no general statewide industrial noise standard. The Georgia Environmental Protection Division (EPD) addresses noise only when tied to permitted facilities, mining (O.C.G.A. 12-4-72), or air quality permits. Industrial noise is otherwise treated as a private or public nuisance under O.C.G.A. 41-1-1 through 41-2-17. Cities and counties may adopt local decibel limits and zoning buffers. Surface mining operations are subject to state reclamation rules, including limited noise considerations during permitting.

Public nuisance under O.C.G.A. 41-2-5 may result in abatement orders. Mining permit noise conditions may trigger EPD enforcement and permit revocation.
