Georgia Plastic Bag Rules Without Statewide Ban or Preemption

Georgia has not adopted a statewide plastic bag ban or fee, and unlike several southern states it has not enacted express preemption forbidding local plastic bag ordinances. Tybee Island and a small number of other jurisdictions have considered local bag rules. Retailers commonly offer plastic and reusable bags. Recycling and waste management requirements under Title 12 (Conservation) apply to disposal. Producers and retailers should monitor local proposals as authority remains contested in the absence of clear preemption language.
