Hawaii Industrial Noise Limits Under HAR 11-46

Under HRS 342F and HAR Title 11 Chapter 46, the Department of Health regulates noise from stationary sources statewide, including industrial machinery, air conditioners, ventilation systems, generators, compressors, and similar mechanical equipment. The rules establish maximum permissible sound levels measured at the property line based on the receiving zoning district (Class A residential, Class B commercial, Class C agricultural/industrial). Daytime and nighttime limits differ. Operators exceeding these levels must obtain a noise variance from DOH. The state framework preempts inconsistent county industrial noise rules.

DOH may issue cease-and-desist orders, civil administrative penalties up to $10,000 per day, and seek injunctive relief through the Attorney General for industrial noise violations of HRS 342F.
