Idaho Statewide Residential Building Height Code Standards

Idaho Code 39-4109 adopts the International Residential Code as the statewide minimum standard for one and two-family dwellings and townhouses. The IRC limits stick-frame residential construction to three stories above grade plane and sets structural height standards based on wind, seismic, and snow load criteria. Idaho Code 39-4116 requires local governments adopting building codes to enforce all provisions of the state code and prohibits amendments less stringent than the state baseline. Zoning height limits are separately set by local jurisdictions, but underlying construction height limits flow from the state-adopted IRC.

Construction exceeding IRC height limits without engineered design and proper permits violates the state building code. Penalties include stop-work orders, civil fines under local enforcement, and inability to obtain certificate of occupancy.
