Kansas Paid Leave Local Preemption for Employers

K.S.A. 12-16,130 preempts local regulation of employee leave benefits, prohibiting Kansas cities and counties from mandating paid sick leave, paid family leave, or paid vacation for private sector workers. Employers may voluntarily offer these benefits and many do as a matter of recruitment and retention. Federal protections such as the Family and Medical Leave Act still apply to covered employers. The preemption is intended to maintain consistent statewide employment standards and avoid a patchwork of local mandates.

Local paid leave mandates conflicting with K.S.A. 12-16,130 are void and cannot be enforced against employers.
