Kansas E-Verify Requirements for Employers

Kansas has not enacted a statute requiring private employers, public employers, or state contractors to use the federal E-Verify electronic employment eligibility system. Use of E-Verify in Kansas remains voluntary in most circumstances, except where federal law independently requires it, such as certain federal contractors under the Federal Acquisition Regulation. Because there is no Kansas statute on this topic, there is no statewide preemption preventing local jurisdictions from setting their own employment eligibility verification rules, though such ordinances are uncommon. Federal Form I-9 employment verification continues to apply to all employers under federal law.

There are no Kansas state penalties for failing to use E-Verify, but federal contractor rules and federal I-9 requirements still apply.
