Louisiana Outdoor Burning Air Quality Rules

LDEQ Air Quality Regulation 1109 (Louisiana Administrative Code Title 33, Part III, Chapter 11) governs outdoor burning across all parishes. The rule prohibits burning materials that produce noxious smoke, including tires, treated lumber, asphalt, plastics, asbestos, paint, and commercial or industrial waste. Residential burning of natural vegetation grown on the property is generally allowed when it does not create a nuisance and is not within an air quality non-attainment parish. Agricultural burns and prescribed forestry burns require notification. Burning is prohibited during ozone alerts and whenever winds carry smoke onto public roadways.

LDEQ violations carry civil penalties up to $32,500 per day per violation under RS 30:2025, and may also constitute a criminal misdemeanor for repeat offenders.
