Louisiana Polystyrene Foam Container Preemption

Polystyrene foam cups, clamshells, and food packaging fall within the definition of auxiliary containers under La. R.S. 33:4169.1, which forbids parishes and municipalities from prohibiting, restricting, taxing, or imposing fees on their use, sale, or distribution. State environmental statutes regulate solid waste disposal, but no statewide polystyrene ban exists. Schools and state agencies may adopt internal procurement policies without violating the preemption.

Municipal polystyrene bans are void and unenforceable; vendors and trade associations may seek injunctive relief and recovery of costs incurred under invalid local rules.
