Louisiana Plastic Straw Statewide Preemption

La. R.S. 33:4169.1 includes straws, stirrers, and similar single-use items within auxiliary containers, barring municipalities and parishes from enacting bans, mandatory request-only rules, or fees. Restaurants may voluntarily switch to paper or compostable alternatives. The statute does not preempt federal accessibility requirements under the ADA, which require restaurants to provide flexible plastic straws when needed for accommodation.

Local straw bans are void; municipal enforcement actions may be enjoined, and businesses harmed by improper enforcement may pursue declaratory relief.
