Maine Animal Cruelty Law Reaches Hoarding Statewide

Maine has no separate hoarding statute, but its consolidated cruelty laws apply universally. Title 17 Section 1031 makes it a Class D crime to deprive an animal of necessary sustenance, medical attention, proper shelter, or humanely clean conditions. Title 7 Section 4011 establishes a parallel civil cruelty violation. Prosecutors elect between criminal and civil tracks based on severity, number of animals, and prior offenses. Title 17 Section 1027 authorizes courts to require security for impounded animals. Animal control officers may seize neglected animals, and courts may permanently bar offenders from owning animals.

Class D crime carries up to 364 days incarceration and $2,000 fines. Civil cruelty fines run $500 to $2,500. Courts may impose ownership bans, restitution, and forfeiture.
