Maine state law: Commercial drone operation

Commercial drone operation in Maine (aerial photography, real-estate marketing, infrastructure inspection, agricultural mapping, surveying, delivery testing) is regulated by federal law under 14 CFR Part 107. Part 107 requires: a Remote Pilot Certificate with a sUAS rating (passing the FAA Part 107 Aeronautical Knowledge Test); FAA registration of each aircraft under 14 CFR § 47.41 / § 48.100 with the operator's registration number displayed; operation only during civil twilight or daylight (night operation requires anti-collision lighting and Part 107.29 compliance); operation within visual line of sight; flight at or below 400 ft AGL in uncontrolled airspace and LAANC authorization in controlled airspace (Class B, C, D, E surface); a maximum airspeed of 100 mph; and prohibition on flight over people unless category 1-4 conditions are met under Part 107 Subpart D. Maine has not enacted a statewide commercial-drone licensing or registration statute. The primary Maine drone statute, 25 MRS § 4501, regulates law-enforcement-agency drone use exclusively (warrant requirement for evidence-gathering surveillance; ban on weaponized UAVs; written-policy requirement coordinated through the Maine Criminal Justice Academy; bar on surveillance of First-Amendment-protected activity; exceptions for search-and-rescue, environmental sampling, and non-criminal-investigation uses). Because 25 MRS § 4501 occupies the regulatory field for the law-enforcement category of drone use AND federal law occupies airspace regulation, municipal commercial-drone-specific licensing schemes face preemption risk under the 30-A MRS § 3001 'frustrate the purpose of any state law' standard. Municipal authority typically extends to (1) prohibiting takeoff/landing/operation from municipal property (parks, sidewalks, public buildings) under the city's proprietary authority over its land, and (2) general nuisance and trespass enforcement — not to issuing or denying commercial-drone operating permits. Commercial drone operators in Maine should additionally consider: 17-A MRS § 511 (violation of privacy), 12 MRS § 11218 (interference with hunting/trapping), and any Shoreland-Zone wildlife-disturbance rules of the Maine Department of Inland Fisheries and Wildlife.

FAA Part 107 enforcement — civil penalties up to $27,500 per violation, Remote Pilot Certificate suspension or revocation, and possible criminal referral. State criminal charges may apply under 17-A MRS § 511 (violation of privacy, Class D) for unauthorized recording in a private place, or 17-A MRS § 402 (criminal trespass, Class E). 25 MRS § 4501 evidence-suppression remedies apply only to law-enforcement drone use.
