Maine state law: residential fence height limits

The Maine Revised Statutes contain no provision fixing a maximum residential fence height in feet. Fence height is regulated through 30-A MRS § 4352 (Zoning ordinances) and 30-A MRS § 3001 (Home rule), which together delegate to each Maine municipality the power to set residential fence-height limits in its zoning code. Typical Maine municipal limits are 6 feet in rear and side yards, 3-4 feet in front yards within the sight-distance triangle, with stricter caps in historic and shoreland districts. Within the mandatory Shoreland Zone (38 MRS § 435 et seq.) — 250 feet from great ponds, rivers, freshwater wetlands, and tidal waters — fences within the 75-foot setback from the normal high-water line must comply with the Maine DEP Shoreland Zoning Standards (Chapter 1000) overlaid on the local zoning code. There is no Maine analog to Colorado's CRS 35-46-101 lawful-fence statute or California's statewide setback rules.

State law itself imposes no fence-height fine. Municipal violations are enforced by the local code-enforcement officer under 30-A MRS § 4452 (consent agreements and civil penalties up to $2,500/day for land-use violations). Shoreland violations may trigger Maine DEP enforcement under 38 MRS § 349 (civil penalties up to $25,000/day for major violations).
