Maine state law: approved fence materials

The Maine Revised Statutes contain no uniform restriction on residential fence materials. Rules prohibiting barbed wire in residential zones, restricting electric fencing in compact urban areas, prohibiting chain-link in front yards, or requiring a 'good neighbor' finished side facing outward are set by individual municipal zoning code under 30-A MRS § 3001 (Home rule) and 30-A § 4352 (Zoning ordinances). The mandatory Shoreland Zoning Standards under 38 MRS § 435 et seq. (DEP Chapter 1000) restrict impervious-surface materials and require vegetated screening within the 75-foot shore buffer — affecting fence design near protected waters. Homeowner association covenants under Title 33 routinely add design-review rules above the municipal baseline. Maine's broad agricultural-protection framework in Title 7 protects pre-existing agricultural fences (including barbed wire on livestock operations) from nuisance claims arising from changes in surrounding land use.

State law imposes no fence-material fine. Municipal zoning violations are enforced by the local code-enforcement officer under 30-A MRS § 4452 (civil penalties up to $2,500/day). Shoreland-buffer violations may trigger Maine DEP enforcement under 38 MRS § 349.
