Maine state law: pool barrier fence requirements

Maine has no separately codified swimming-pool barrier statute. Residential pool barrier requirements are imposed through the Maine Uniform Building and Energy Code (MUBEC), adopted statewide under 25 MRS § 2451 and mandatory in municipalities of 4,000+ population. MUBEC incorporates by reference the International Residential Code (IRC) Appendix G and the International Swimming Pool and Spa Code (ISPSC), which apply to all pools, spas, and hot tubs capable of containing 24 inches or more of water. Barrier requirements: (1) minimum 48 inches in height measured on the side facing away from the pool; (2) no more than 4 inches between vertical members (or no more than 1¾ inches in horizontal-member designs to prevent climbing); (3) no more than 2 inches between the bottom of the barrier and the ground; (4) self-closing, self-latching gate with the latch release a minimum of 54 inches above grade and opening outward away from the pool; (5) an isolation barrier separating the pool from the dwelling OR pool/door alarms on all doors providing direct access from the dwelling to the pool area. Public and semi-public pools are separately licensed under 22 MRS § 1623 et seq. by Maine DHHS Health Inspection Program under 10-144 CMR Chapter 202. Premises-liability exposure for unfenced backyard pools is governed by common-law negligence and the attractive-nuisance doctrine.

MUBEC violations are enforced at the building-permit and final-inspection stage by the local code-enforcement officer. A pool without a compliant barrier may not receive a Certificate of Occupancy. Continued operation of a non-compliant pool can trigger municipal civil penalties up to $2,500/day under 30-A MRS § 4452. Premises-liability exposure under the attractive-nuisance doctrine is independent of code compliance.
