Maine state law: retaining wall permits and engineering

Retaining wall construction in Maine is regulated through the Maine Uniform Building and Energy Code (MUBEC), adopted statewide under 25 MRS § 2451 and mandatory in municipalities of 4,000+ population (smaller towns may opt in). MUBEC incorporates the International Residential Code (IRC) and International Building Code (IBC). Per IRC § R105.2, retaining walls that are NOT over 4 feet in height measured from the bottom of the footing to the top of the wall, AND that do not support a surcharge or impound Class I, II, or III-A liquids, are EXEMPT from the building-permit requirement. Walls 4 feet or taller (footing to top), or any wall that retains a slope supporting a structure, driveway, or other surcharge, require a building permit and engineered drawings stamped by a Maine-licensed professional engineer under Title 32 MRS § 1251 et seq. (Engineering Licensure). Within the mandatory Shoreland Zone (38 MRS § 435), retaining walls within the 75-foot setback are constrained by DEP Chapter 1000 erosion-control and impervious-surface limits. Walls in the Flood Hazard Area must comply with FEMA NFIP standards as administered by the local Floodplain Management Ordinance.

Building without a required permit triggers municipal stop-work orders and civil penalties up to $2,500/day under 30-A MRS § 4452. Practicing engineering without a license (preparing structural calculations for sale) is a Class E crime under 32 MRS § 1252. Shoreland violations may trigger Maine DEP penalties up to $25,000/day.
