Maine state law: wildfire risk zones and fire-danger ratings

Maine has no statewide wildland-urban interface (WUI) zoning overlay, fire-hazard severity zone map, or WUI building-code overlay equivalent to California's PRC § 4201 / 14 CCR § 1280, Colorado's HB23-1273 WUI map, or the International Wildland-Urban Interface Code as a stand-alone Maine adoption. The Maine Forest Service (Maine DACF Bureau of Forestry), under 12 MRS Chapter 805, operates the Wildfire Danger Report and Fire Danger Rating System statewide, using the federal National Fire Danger Rating System (NFDRS) which classifies daily wildfire risk as Low, Moderate, High, Very High, or Extreme (historically referenced as Class I through V). Per the Maine Forest Service: "this system is only operational during Maine's wildfire season between late March and late November." The fire-danger class triggers two operative legal consequences: (1) burn-permit issuance is prohibited on Class III, IV, or V days and during red-flag warnings under 12 MRS § 9321; and (2) recreational campfires under 3 feet in diameter lose their no-permit exemption on Class III/IV/V days. The Maine Forest Service FireWise Communities USA program (in partnership with NFPA) provides voluntary community-level risk-reduction certification to municipalities. The mandatory Maine Uniform Building and Energy Code (MUBEC, 25 MRS § 2451) does not currently incorporate the International WUI Code as a state-required overlay; municipalities may opt to adopt the IWUIC locally under 30-A MRS § 3001 home-rule authority but few have done so. Wildfire risk in Maine is concentrated in the spring shoulder season after snowmelt and before green-up, and in the late-summer drought window — both periods routinely produce Class III/IV days when the state burn-permit system is suspended.

There is no civil or criminal penalty for residing in or building in a high-fire-danger area in Maine — the state imposes no mandatory WUI construction standard. Penalties for burn-permit violations on Class III/IV/V days are civil under 12 MRS § 9325 (typically $100-$1,000).
