Maine grants broad home-rule authority under 30-A MRS § 3001: 'Any municipality, by the adoption, amendment or repeal of ordinances or bylaws, may exercise any power or function which the Legislature has power to confer upon it, which is not denied either expressly or by clear implication.' Section 4352 separately empowers municipalities to enact zoning ordinances. Together these statutes leave home-occupation regulation to local code. Within the mandatory Shoreland Zone (38 MRS § 435 et seq., 250 feet from great ponds, rivers, freshwater wetlands, and tidal waters), new commercial uses face additional restrictions administered by the local Shoreland Code-Enforcement Officer. The Maine Uniform Building and Energy Code (25 MRS § 2451) overlays any construction or change-of-use that accompanies a home business.
