Maine has not enacted legislation requiring private employers to use the federal E-Verify employment eligibility system. Title 26 governs Maine wage and hour rules but does not impose state E-Verify obligations beyond federal Form I-9 compliance under 8 USC 1324a. Federal contractors with applicable FAR clauses must use E-Verify regardless of state law. Maine does not preempt municipal E-Verify ordinances, leaving room for local action, though no Maine municipality currently mandates participation. Employers must continue to complete Form I-9 for every new hire and avoid discrimination based on national origin.

Federal I-9 violations may carry civil fines from $281 to over $27,000 per worker under 8 USC 1324a; Maine does not impose separate state-level E-Verify penalties.
