Maine state law: construction hours and noise

There is no Maine Revised Statute that fixes residential, commercial, or industrial construction start and stop times. Two layered authorities apply: (1) 17-A MRS Section 501-A criminalizes 'loud and unreasonable noise' as Class E disorderly conduct, which can apply to construction noise that crosses the reasonableness threshold (especially impact noise, jackhammering, or early-morning equipment startup); and (2) 30-A MRS Section 3001 (Ordinance Power) grants every Maine municipality broad home-rule authority to adopt construction-hour ordinances. Section 3001 states: 'Any municipality, by the adoption, amendment or repeal of ordinances or bylaws, may exercise any power or function which the Legislature has power to confer upon it, which is not denied either expressly or by clear implication... There is a rebuttable presumption that any ordinance enacted under this section is a valid exercise of a municipality's home rule authority.' Typical Maine municipal construction windows: 7 AM-7 PM weekdays, 8 AM-5 PM Saturdays, no Sunday/holiday construction in residential zones.

State-law violation (disorderly conduct) is Class E: up to 6 months jail / $1,000 fine. Municipal construction-hour violations typically carry civil fines ($100-$500 per occurrence) plus stop-work orders.
