Maine state law: industrial and commercial noise

Industrial-scale projects in Maine - quarries, wind power generators, large manufacturing facilities, asphalt plants - that fall under the Site Location of Development Act (38 MRS Section 481 et seq.) are reviewed by the Maine Department of Environmental Protection. DEP Chapter 375 'No Adverse Environmental Effect Standard of the Site Location of Development Laws' includes noise standards (typical limits 55 dBA daytime / 45 dBA nighttime at protected locations such as residences) reviewed during licensing. For wind energy projects specifically, 35-A MRS Section 3451 et seq. (Expedited Permitting of Grid-Scale Wind Energy Development) requires DEP noise review. Smaller commercial uses below SLODA thresholds fall to municipal noise ordinances under 30-A MRS Section 3001. The criminal floor remains 17-A MRS Section 501-A (Class E disorderly conduct). Maine has no general statewide commercial-noise decibel limit applicable to all businesses.

DEP enforcement under 38 MRS Section 349: administrative penalties up to $10,000 per day per violation for site-location noise non-compliance. Municipal civil fines for commercial-noise violations typically $250-$2,500 per occurrence. Class E disorderly conduct is up to 6 months / $1,000.
