Maine state law: no statewide night cap; municipalities may cap STR nights

The Maine Revised Statutes do not impose a statewide annual-night cap on short-term rentals (no analog to New York City's 30-night unhosted limit or San Francisco's 90-night unhosted cap). Maine state tax law distinguishes only between stays under 28 days (subject to the 9% lodging tax under 36 MRS § 1811) and stays of 28 days or more (treated as residential rentals exempt from lodging tax) - that is a tax classification, not a regulatory night cap. Municipalities may set night caps under 30-A MRS § 3001 home-rule authority. Bar Harbor uses license categories that effectively cap rental nights for certain non-owner-occupied units; Portland does not impose an absolute annual night cap but limits the total number of registered non-owner-occupied STRs by district. The state ADU statute (30-A MRS § 4364-A, LD 2003) prohibits municipalities from requiring owner-occupancy of an ADU, but does not directly address STR night caps for ADUs. Municipal fines (typically $100-$500/day per night over the cap in cities that impose them) and STR-permit revocation under local code; no state-level penalty.
