A residential hot tub or spa capable of containing 24 or more inches of water is subject to the same barrier requirements as a swimming pool (48-inch barrier, self-closing self-latching gate, isolation from dwelling, or door alarms — IRC Appendix G) UNLESS equipped with a safety cover complying with ASTM F1346 (locking, capable of supporting a child's weight, with appropriate signage). Electrical installation must comply with NEC Article 680 (bonding and grounding of equipotential surfaces; GFCI protection for receptacles; minimum setback of electrical equipment from spa walls). Plumbing work must be inspected by the state-licensed Local Plumbing Inspector under 22 MRS § 2491. A building permit is typically required for hard-wired in-ground spas and for permanently installed above-ground spas; portable plug-in spas under 120V may be exempt under IRC R105.2 but the local code-enforcement officer makes the final call. Public and semi-public hot tubs and spas (apartments, hotels, gyms, condos) are licensed annually by Maine DHHS under 22 MRS § 1623 et seq. and 10-144 CMR Chapter 202, with water-chemistry standards (free chlorine 2.0-5.0 ppm or bromine 3.0-6.0 ppm; pH 7.2-7.8; temperature limit 104°F).

Installing a hot tub without a required electrical or plumbing permit triggers municipal stop-work orders and civil penalties up to $2,500/day under 30-A MRS § 4452. NEC Article 680 grounding/bonding violations are a serious electrocution hazard — non-compliant installations will not pass inspection. Operating a public/semi-public spa without a DHHS license can result in closure under 22 MRS § 1641.
