Maine state law: residential pool construction permits

Maine has no state-level residential swimming-pool construction permit. In-ground and above-ground pools capable of containing 24 or more inches of water, plus spas and hot tubs, require a building permit from the local municipal code-enforcement officer under the building-code authority of 25 MRS § 2451 (Maine Uniform Building and Energy Code). MUBEC incorporates the International Residential Code, International Building Code, International Plumbing Code, National Electrical Code (Article 680 bonding and grounding), and the International Swimming Pool and Spa Code (ISPSC). Plumbing inspection is performed by the state-licensed Local Plumbing Inspector under 22 MRS § 2491 et seq. (Plumbing Code subdivision). Within the Shoreland Zone (38 MRS § 435 — 250 feet from great ponds, rivers, freshwater wetlands, and tidal waters), pools must comply with the 75-foot setback and impervious-surface limits administered by the local Shoreland Code-Enforcement Officer under Maine DEP Chapter 1000. Pools in the FEMA Flood Hazard Area must comply with the local Floodplain Management Ordinance. Typical Maine municipal permit fees range from $150 to $500. Public/semi-public pools are separately licensed by Maine DHHS under 22 MRS § 1623.

Construction without a required permit triggers municipal stop-work orders and civil penalties up to $2,500/day under 30-A MRS § 4452. Performing plumbing work without a state license is a violation of 22 MRS § 2491 et seq. Shoreland Zone violations may trigger Maine DEP enforcement under 38 MRS § 349 with civil penalties up to $25,000/day.
