Maine state law: Trash pickup rules

Maine's curbside trash collection schedule, container, and set-out rules are set at the municipal level. The principal state-law authorities are: (1) 30-A MRS § 3001 — broad home-rule grant for municipal ordinances; (2) 30-A MRS § 3401 et seq. — municipal solid-waste powers and duties (authority to establish collection systems, contract with private haulers, operate transfer stations, and adopt mandatory-collection ordinances); and (3) 38 MRS § 1304 (Solid waste management regulations) — DEP licensing of disposal facilities and hauler standards. None of these set a statewide residential set-out time, container size limit, or collection-day schedule. Each Maine municipality independently establishes: (a) collection days by neighborhood or street; (b) acceptable containers — city-issued totes, contractor-supplied bins, or open trash bags depending on the program; (c) set-out and take-back windows (typical statewide pattern: no earlier than 4:00 p.m. or 7:00 p.m. the day before collection, removed within 24 hours after collection); (d) holiday-schedule shifts; (e) volume limits and pay-as-you-throw (PAYT) bag programs (Maine has the highest PAYT participation rate of any state — over 140 Maine municipalities operate PAYT under their home-rule authority); and (f) prohibition on hazardous waste, electronics, and bulky items in regular curbside service. Hauler licensing for private trash collection is administered by DEP under 38 MRS § 1304. Penalties for set-out violations are typically civil infractions $50-$500 per offense under the municipal solid-waste ordinance. Maine's Universal Recycling Law / Container Deposit Law (38 MRS § 3101 et seq.) imposes statewide deposit-redemption on beverage containers but does not set curbside-pickup timing.
