Maryland Predictive Scheduling and Local Authority

Maryland's Labor and Employment Article does not currently mandate predictive or fair workweek scheduling, leaving employers flexibility under federal Fair Labor Standards Act standards. The state has considered legislation requiring 14-day advance schedules and predictability pay for retail and food service workers, but no statewide bill has passed as of 2026. Charter counties retain authority to adopt local fair workweek ordinances; Montgomery County has explored such rules. Employers must still comply with overtime and reporting time requirements under existing wage law.

Where local fair workweek rules exist, employers may face fines of $500 per affected worker for last-minute schedule changes without predictability pay.
