Minnesota Plastic Straw Rules and Local Authority

There is no Minnesota statute prohibiting plastic straws statewide. After the legislature repealed Minn. Stat. 325E.045 preemption in 2023, cities regained authority to regulate plastic straws and other auxiliary food service items. Minneapolis and Saint Paul programs encourage upon-request straw service and compostable alternatives, while the Americans with Disabilities Act requires accommodations for people who need plastic straws as a medical aid. Restaurants should provide non-plastic defaults while keeping flexible straws available on request.

Failure to comply with local straw rules may result in administrative fines under municipal sustainability and food packaging codes.
