Mississippi Limits on HOA Power: No Solar-Access or State Flag Statute; Federal Flag & Dish Rules Apply

Mississippi has not enacted the HOA-override statutes common in other states. National solar-policy trackers confirm Mississippi has no solar-access or solar-easement law, so a recorded covenant may regulate or even prohibit solar panels. Mississippi also has no state statute protecting flag display from HOA covenants; that protection comes from the federal Freedom to Display the American Flag Act of 2005, which bars associations from prohibiting a U.S. flag display (HOAs may still set reasonable placement rules). Likewise, satellite dishes and antennas are protected not by Mississippi law but by the FCC's Over-the-Air Reception Devices (OTARD) rule, which limits HOA restrictions while allowing reasonable placement conditions. Mississippi has no clothesline, EV-charging, or political-sign statute overriding HOAs, so those remain governed by the declaration.

Because Mississippi provides no solar, flag, or sign override, a restrictive covenant generally remains enforceable on those topics, subject only to the federal flag and FCC dish protections. A covenant that violated those federal rules would be unenforceable as to the protected display.
