Montana Open Carry Rules and State Preemption

Montana has no general state law restricting the open carry of handguns or long guns by adults legally able to possess firearms. The state preemption statute, MCA 45-8-351, prevents local governments from enacting more restrictive open carry rules, except for narrow exceptions concerning discharge in populated areas and possession in certain publicly owned buildings. Federal restrictions, school zones, and private property rules still apply.

Carrying in restricted locations such as schools, courthouses, or posted private property may result in trespass or weapons charges depending on the venue and circumstances.
