Montana E-Verify and Employer Mandates

Montana has no statute requiring private employers generally to use the federal E-Verify system to confirm employment eligibility of new hires. Federal contractors remain subject to E-Verify requirements under federal procurement rules, and certain state-funded contracts may require participation by agency policy. Most private Montana employers may choose whether to enroll in E-Verify voluntarily. Federal Form I-9 employment eligibility verification still applies to all employers nationwide regardless of E-Verify status.

There are no state penalties for non-use of E-Verify by private employers; failure to complete I-9 verification or knowingly hiring unauthorized workers carries federal civil and criminal penalties.
