Nebraska Polystyrene Foam Status and Local Authority

The Integrated Solid Waste Management Act, Neb. Rev. Stat. 13-2001 to 13-2043, and the Title 132 waste rules govern landfills and recycling planning, but do not target expanded polystyrene foam (EPS). No statewide ban applies to foam foodware, coolers, or shipping foam. Nebraska legislative proposals to preempt local bans on auxiliary containers, such as LB 877 (2020), did not pass, so cities retain home-rule authority to address foam through ordinance. As of 2026, no Nebraska city operates an enforced EPS ban. Retailers and food service operators must still comply with litter, recycling, and stormwater rules, and the Department of Environment and Energy administers recycling grants.

Improper disposal of foam containers can be cited under the Litter Reduction and Recycling Act and local litter ordinances. Penalties typically range from infraction-level fines to Class V or IV misdemeanors for willful or repeated violations.
